6.1 Introduction and acceptance These Terms and Conditions govern access to and use of The Math DJ website, client accounts, online courses, memberships, assessments, digital resources and related services. By accessing the website, creating an account, purchasing a course or membership, or using the services, the client agrees to these Terms and Conditions, the Privacy Policy, the Refund Policy and any course-specific terms displayed at the time of purchase. A person who does not agree to these terms should not use the paid services. Nothing in these terms is intended to exclude a consumer right or supplier obligation that cannot lawfully be excluded under applicable South African law. 6.2 Definitions Client: a person who visits the website, creates an account, purchases or accesses a course or uses a service. Course: an online programme, lesson, module, video, activity, assessment, document or related learning resource offered through The Math DJ. A purchase grants the registered client a limited, non-exclusive, non-transferable and revocable right to access the relevant content during the stated access period. It does not transfer ownership of the content or permit commercial exploitation. 6.6 Prohibited conduct • sharing an account or login credentials with another person; • copying, recording, reproducing, republishing, distributing, selling or uploading course content without written permission; • circumventing access controls, download limits, security measures or payment requirements; • using automated tools to scrape, download or extract content; • interfering with the website, servers, networks or another client’s account; • introducing malicious code, viruses or harmful material; • submitting fraudulent information or using an unauthorised payment method; • harassing staff, lecturers or other clients; • impersonating another person or misrepresenting identity, completion or results; and • using the services in a manner that is unlawful or infringes intellectual-property, privacy or other rights. 6.7 Course information and enrolment The course page will describe the subject matter, intended audience, expected outcomes, included resources, prerequisites where applicable, price and access period. Clients are responsible for reviewing this information before purchase. Course illustrations, previews and descriptions are intended to provide an accurate general indication, but minor presentation changes may occur as content is improved. 6.8 Prices, payments and taxes Prices are displayed in the currency stated on the website and may include or exclude applicable taxes as indicated. Payment must be completed through an accepted method before paid access is granted, unless otherwise stated. The Math DJ may correct an obvious pricing or technical error and will contact an affected client where a completed transaction requires correction. Promotions are subject to their stated period, eligibility requirements and limitations and may not be combined unless expressly allowed. 6.9 Course access Access begins at the time stated at checkout, in the order confirmation or on the course page. Access may be for a fixed period, for the duration of an active membership or under another stated arrangement. Failure to use the course during the access period does not automatically extend access or create a refund entitlement. The Math DJ may offer an extension at its discretion or under a published extension policy. 6.10 Memberships and renewals Where memberships are offered, the membership page will identify the price, billing frequency, eligible courses, exclusions and cancellation method. A recurring membership renews only where the client has agreed to recurring billing and the payment provider supports it. Clients must cancel before the next billing date to prevent a future charge. Cancellation ordinarily stops future renewal but does not retrospectively refund a period already paid for, subject to the Refund Policy and applicable law. 6.11 Course changes and availability The Math DJ may update, reorganise or replace course content to improve accuracy, quality or usability. It may temporarily suspend access for maintenance, security, technical issues or events beyond reasonable control. If a paid course is permanently withdrawn before the client has had a reasonable opportunity to use it, an appropriate remedy may be offered, such as alternative access, an extension, credit or refund, taking account of the circumstances and applicable law. 6.12 Assessments and academic integrity Assessments and practice activities are intended for the registered client. Clients must submit their own work and must not manipulate completion records, assessment results or certificate requirements. The Math DJ may invalidate results or withhold a certificate where there is credible evidence of cheating, impersonation, account sharing or technical manipulation. 6.13 Certificates Selected courses may include a certificate of completion where stated on the course page. Certificates may require completion of specified lessons, activities or assessments. Unless expressly stated otherwise, a certificate of completion confirms participation or completion of the relevant course requirements and is not a degree, accredited qualification, professional licence, statutory certification or guarantee of competence, employment, admission or promotion. 6.14 Intellectual property All website and course content is owned by or licensed to The Math DJ and is protected by applicable intellectual-property law. The Math DJ name, branding, course materials, layout, videos, notes, questions, graphics and other original content may not be used beyond the limited permission granted under these terms. A client may download or print a resource only where the platform expressly permits it and only for the client’s personal educational use. 6.15 User submissions and feedback Where clients submit reviews, comments, questions or feedback, they must ensure that the material is lawful, respectful and does not disclose confidential information or infringe another person’s rights. The client grants The Math DJ permission to use genuine feedback for service improvement and, where separately authorised or appropriately anonymised, for promotional purposes. Testimonials identifying a client should not be published without appropriate permission. 6.16 Support and communications Support is provided through the channels and during the operating periods stated on the website. Response times may vary according to the nature and volume of enquiries. Electronic notices sent to the email address linked to the account are deemed directed to the client, and the client should keep contact details current and monitor relevant folders. 6.17 Technical requirements and client responsibility Clients are responsible for a compatible device, supported browser, reliable internet connection and any software reasonably required to use the service. The Math DJ is not responsible for failures caused solely by the client’s device, connectivity, unsupported software or failure to follow reasonable technical instructions, although support may assist in diagnosing access issues. 6.18 Third-party services The website may rely on hosting, learning-management, video, analytics, email and payment services provided by third parties. Their availability and separate terms may affect parts of the service. Immediate action may be taken where necessary to protect the platform, content, staff, service providers or other clients. Termination for client misconduct does not automatically create a refund entitlement. 6.21 Refunds and cancellation Refunds, purchase cancellations and membership cancellations are governed by the Refund Policy and applicable law. Clients should submit requests promptly and provide the information reasonably required to identify the transaction and assess the request. 6.22 Limitation of liability To the maximum extent permitted by law, The Math DJ is not liable for indirect, special or consequential loss arising from use of or inability to use the service, loss caused by unauthorised account use resulting from the client’s failure to secure credentials, or loss arising from third-party systems beyond reasonable control. The Math DJ’s liability for a particular paid service will not exceed the amount paid for that service, unless a greater liability cannot lawfully be excluded or limited. Nothing in these terms excludes liability for gross negligence, wilful misconduct or any right or remedy that applicable law does not permit the parties to exclude. 6.23 Indemnity To the extent permitted by law, the client is responsible for loss, damage or reasonable cost caused by the client’s unlawful conduct, infringement of rights, unauthorised distribution of content or material breach of these terms. This clause does not require a consumer to indemnify The Math DJ against its own unlawful conduct or responsibility that cannot legally be transferred. 6.24 Complaints and dispute resolution A client should first submit a complaint through the official contact channel, describing the issue and the requested resolution. The Math DJ will make reasonable efforts to investigate and respond. If the dispute cannot be resolved directly, the parties may use an applicable consumer-protection or regulatory process, mediation or a competent South African court. Nothing prevents a consumer from approaching a regulator or forum where permitted by law. 6.25 Governing law These terms are governed by the laws of the Republic of South Africa.
